Let me try to clarify some of the questions: 1. Geneva Convention IV (GC): This convention was signed and ratified by the State of Israel and there is no doubt whatsoever that it binds Israel in international law. This has never been contested. To say that is it meaningless legally is to say that international law is meaningless. I hope nobody really thinks that. 2. While the GC binds Israel a number of questions have arisen: a. Non-incorporation in domestic law; According to the British rule adopted in Israeli jurisprudence (well before 1967) an international treaty will not be enforced in domestic courts unless it has been incorporated in domestic law by a Knesset statute. GC was never incorporated and so the Supreme Court has held that it cannot be enforced domestically. (The Court rejected the argument that the usual rule of non-enforcement should not apply to treaties relating to war and occupied territory). It should be added, that customary international law is enforced by domestic courts (unless it is expressly contradicted by Knesset legislation). The Court has refused to regard the GC as reflective of customary law. b. Non-application: Meir Shamgar, while Attorney General, raised that the argument that GC does not apply to the occupation of the West Bank and Gaza. This was based on an interpretation of article 2 (2) of GC which states that "the Conventions shall also apply to all cases of partial or total occupation of the territory of a High Contracting Party, even if the said occupation meets with no armed resistance." His claim was that as neither the West Bank nor Gaza were territories of High Contracting parties when taken by Israel in 1967 the GC does not apply to this particular situation. In my mind (and that of almost all experts in international law) this is a weak argument. For two reaons: 1. article 2(2) is only needed when the occupation does not arise out of an armed conflict (hence the word "also"). Under article 2 (1) the GC applies to "all cases of declared war or any other armed conflict which may arise between two or more of the High Contracting parties." Under this paragraph the GC definitely did apply to the armed conflict between Israel, Jordan and Egypt in 1967, including all the consequences of that conflict. 2. Even if one accepts that art. 2(2) applies, the object of the GC is humanitarian (protection of the people in the territory) and the term "territory of a High Contracting Party" must therefore be given a wide interpretation. It applies to all territory taken from one country by another in the course of an armed conflict, irrespective of whether the country form which the territory was taken was the recognized sovereign in the territory. On the strength of Shamgar's argument the Government of Israel consistently argued in international fora that the GC does not formally apply to the West Bank and Gaza but that it would nevertheless respect its humanitarian provisions. The Supreme Court has never ruled on Shamgar's argument (although there is a dictum of Justice Witkon that the GC does apply). Practically all experts in international law, and all foreign governments, hold that the GC does apply to the West Bank and Gaza (though questions did arise as to is applicability in Gaza after the Peace Agreement with Egypt and its application in A areas after the Oslo accords and subsequent agreements). 3. Interpretation of the Geneva Convention The States parties have no special authority in interpreting the GC. It must be interpreted by domestic courts, international tribunals, legal advisors, the ICRC and other bodies before whom it may be relevant. Thus the correct interpretation is not a matter for a meeting of the States parties. The idea of convening such a meeting was not to adopt an authoritative interpretation, but that the States parties have a duty to ensure compliance by other states (this notion is strongly contested by many legal experts). It should be mentioned here that a few international experts who have been highly critical of many of Israel's actions in the OT have conceded that Israel is still the only country that has paid any attention to the GC (there have been other cases of occupation since 1949 in which the GC was totally ignored). 4. Status of the West Bank and Gaza This question does not necessarily depend on the application of the GC. Besides the GC there is another body of international law that applies to occupied territories - the Hague Regulations, that are accepted as part of customary international law that will (and have been) applied by domestic courts. It is interesting that while the Government of Israel has made the argument in international fora that the GC does not apply to the West Bank and Gaza it has never seriously argued before the Supreme Court of Israel that the Hague Regulations do not apply. In fact, over thirty odd years the government has relied on the Hague Regulations to justify some of its actions in court. In the famous Elon Moreh case the Gush Emunim settlers argued that the court should not apply international law in examining the legality of the requisition of land on which the settlement was being built. Justice Landau's reply is revealing: he said that if he were to accept the argument the settlers would lose the case as the only legal basis for the requisition was the law of belligerent occupation which allows a military commander to requisition land for military needs. It seems difficult to understand how a government can use the powers of a belligerent occupant under international law (Beth El is established on land requisitioned for military needs) and still argue that that law does not really apply! In summary: there is almost total international consensus that the West Bank and Gaza are occupied territory (subject to a question about A areas in which Israel no longer has effective control). The Supreme Court of Israel has ruled on the basis of the assumption that these territories are indeed subject to a regime of belligerent occupation. 5. Settlements There are a number of arguments against the legality of settlements. They are all based on the (well-founded) assumption that the Territories are indeed subject to the international law of belligerent occupation. a. Article 49 (6) of GC: "The Occupying power shall not deport or transfer parts of its own civilian population into the territory it occupies." On the face of this provision it seems clear that settlements established by the government, or with government support, are illegal. (There may be a question relating to private purchase of land without government support or subsidy, but this is not significant in the present case.) An attempt has been made to argue that the above provision only applies to forcible transfer. This won't wash. First, article 49 (1) expressly mentions "forcible transfers". Meklal hen ata shomea lav. Second, the object of the GC is to protect the people in the occupied territory and not the citizens of the occupying power. From the point of view of the people in the occupied territory it is of no significance whether the transfer is forcible or not. It has also sometimes been argued that the object of article 49 (6) is to avoid displacement of the local population and as people have not been displaced the article does not apply. This is somewhat like arguing that as the object of a speed limit is to prevent accidents, one is not guilty of speeding unless one causes an accident. b. There are several other arguments against the legality of settlements. First, a military occupant may not confiscate private land. It may requisition such land for military needs. Establishing settlements cannot be regarded as military needs. Furthermore, requsition is a temporary measure, whereas a settlement is supposed to be permanent. The Supreme Court held (in the Beth El and a few other cases) that specific settlements were indeed established for security reasons, which can be regarded as military needs. However, in the Elon Moreh case it held that the settlement was established for political reasons and overruled the requisition of private land. It also held that the intention of a permanent settlement was incompatible with the notion of requisition. Since then the use of private land for settlements has been abandoned. Second, under the Hague Regulations, the occupying power holds public land as a trustee for the public and may only use such land as a usufruct (it may enjoy fruits, but not capital). Use of public land for the benefit of citizens of the occupying power would seem totally inconsistent with this duty of the occupying power. Finally - a military government in occupied territory must be guided only by one or both of two considerations: benefit of the local population or military needs. Establishment of settlements to further political interests of the occupying power (or parts of its population) are therefore illegal. 6. The Court and Settlements Relying on domestic non-enforceability of the GC the Supreme Court has never ruled on the article 49 (6) argument. It has ruled that settlements may serve a military need. In 1991 Peace Now submitted a petition challenging the legality of all settlements - based, inter alia, on all the above arguments. The petition was dismissed on grounds of non-justiciability. The Court did not rule on the merits. In another case in which a Palestinian tried to challenge use of land declared public land for building a settlement, the Court held he did not have the standing to raise the question! It is a road to collective suicide. He writes (in response to Prof. Gavison): "You are right in claiming that the Status Quo is not good for us. So, what should be done? How about simply conquering the Palestinians, removing their leaders, convince the Arab population that it is to their advantage to elect moderate leaders, who search for what is good for the Arabs and come to the conclusion to their best course is to reach an end-of-conflict solution with the Israelis. To make this happen, we need also the support of the other Arab nations. That means, perhaps, changing the regimes in some of these countries. For this we need the help of the Americans and it seems to me that their interest in fighting Islamic Terror conforms with our small interest in our small country." So the end of conflict will come in three stages. First we occupy the Palestinians and remove their leadership. Secondly we occupy other Arab States (Egypt? Syria?) and change their regimes, so they will convince the Palestinians to end the conflict with us. Thirdly, we join our American allies in an all out war of the West against Islam, at the end of which, no doubt, the end of the conflict will be reached. What can we say about this type of thinking? Empires that were a lot stronger than we are have been destroyed in the past through their own failure to recognize the limits of their power. Maschler's "peace" plan, which is really, beneath the rhetoric, a plan for another world war, is a symptom of such a failure. It is the counsel of Akhitophel. If followed, it will bring us to destruction. Like many Israelis, Prof. Maschler seems to identify wars with their early spectacular military gambits, i.e., with organized forces moving from here to there. That is, perhaps, why he believes so confidently that we're going to come out victorious from his version of "the conflict to end all conflicts." But wars have a nasty tendency to drag on and on, and to pull some unpleasant surprises as they do so. The ultimate outcomes of big wars are rarely identical with their expressed aims, and they bring in their wake carnage, destruction, immense suffering, and very often -defeat. I concur with Prof. Gavison that our best chances lie with returning to the negotiating table on the basis of Clinton's plan. Unlike her, I don't feel that I am (with this view) in any majority. I suspect very much that the majority of public opinion in this country is presently much closer to Prof. Maschler's views. Certainly, our country's current leadership is closer to that view. It is a frightening thought. Of course, our American allies are very strong, but let us not forget the South Vietnamese, for example, or the Cambodians, who made similar calculations, and were left holding the pieces. After we decide that settlements on land occupied after 67 are illegal, I assume that the same standard will be applied to land occupied in 48. But again, that is only my opinion. If that is so, the fact that Israel will not remain a viable state within the 47 borders is not a sufficient reason to violate international law. If, on the other hand, the argument is made that international resolutions recognize that Israel is entitled to secure and defendable borders, then it is possible (probable?) that the 67 borders do not qualify, in which case it is hard to call all the settlements (you said "one and all") illegal. I fail to see how our occupation of the Judea and Samaria differs (in a legal sense) form our occupation of the rest of the land. As for Micah Leshem's snide reply (which really has nothing to do with my original comment) -- he may think that Hamas, tanzim, and all the rest are resistance groups forced into their actions by the terrible Israeli's and their horrible government. I think they are a fascists whose "struggle" is only to eliminate a Jewish state from this area. I think that they have educated a generation to believe that the Jews are the source and reason for all of their troubles. However, there is an additional level. There are cases (I know of one specifically) where the High Court Ruled that the settller's occuption of village lands was illegal and ruled that the property should be returned to its owners. It was not returned, and Israel Police were there to prevent Palestinain villagers from entering their property. There was no persecution for contempt of court, and the lands have still not been returned, some 4 years after the ruling. The Settlement established there is doing well. So legality-illegality is a win-win situation in terms of establishing settlements. (According to him this instigated the snow ball that led to the disintegration of the Soviet Union, for reasons too complicated to explain here). I open the Newspaper and I read that Moslems are causing Havoc in the Philipines and other countries. I also read that the Americans are disillusioned with Saudia, realizing that the Saudies are involved in every aspect of world terror. I read that Al Quaida people are having cells in many countries. We have to face it: we are in the midst of global war between fundamentalist Moslems and the rest of the world. Two days ago I listened to a press conference with Donald Rumsfeld. He said that the 21st Century is going to be completely different from the 20th Century if means of Mass destruction, like Atomic weapons will be in the hand of Saadam Housein. (Barak said the same, according to CNN). Housein manufactures such means. He employed them in the past agaist Moslem "brethren", who are now engaged in procuring the same weapons.
